Brazil’s Supreme Court Rules That Bolsonaro Must Begin Serving His Sentence In The Federal Police’s Detention Center

The former president will serve the beginning of his 27-year sentence imposed by the Supreme Court for plotting a coup d'état in the Federal Police jail in Brasília.

The Supreme Federal Court (STF) decided this Tuesday (25) that Jair Bolsonaro (PL) will remain in custody at the Federal Police (PF) Superintendency in Brasília, where he has been detained since his preventive arrest. The STF recognized the end of the coup plot process and consolidated the execution of the sentence, set at 27 years and three months. Before being taken to the PF, Bolsonaro was serving preventive house arrest in a condominium in Jardim Botânico, in the federal capital.

Court rejects transfer and maintains current place of custody

Speculation about a possible transfer to the Papuda Penitentiary Complex has been dismissed. Allies had raised this possibility, but the Supreme Court opted to preserve the current regime due to the legal prerogatives afforded to former presidents of the Republic.

Cell structure and special conditions

The space where Bolsonaro is being held has recently undergone renovations. The room is 12 square meters and follows the standard for a General Staff room, as stipulated by law to guarantee the safety and integrity of authorities with special privileges.

The room includes a private bathroom, bed, desk, wardrobe, air conditioning, television, mini-fridge, and chair. The standard is similar to the room where President Luiz Inácio Lula da Silva (PT) was imprisoned at the Federal Police headquarters in Curitiba, during a period when his conviction was later overturned by the Supreme Federal Court. Michel Temer was also detained in a Federal Police unit in Rio de Janeiro for four days after being arrested in Operation Decontamination, an offshoot of Lava Jato.

Prerogatives provided for by Brazilian legislation

The law stipulates that former presidents are entitled to facilities commensurate with their previous role, ensuring preferential conditions and physical protection. Bolsonaro’s continued stay at the Federal Police headquarters fulfills this provision, preventing his transfer to units within the regular prison system.

Jair Bolsonaro (PL) had his ineligibility extended until 2033, after Supreme Federal Court (STF) minister Alexandre de Moraes decreed the execution of his sentence this Tuesday (25). According to the publication, the new restriction stems from the conviction in the case related to the coup plot, judged by the First Panel of the Supreme Federal Court. With the collegiate decision, Bolsonaro will remain barred from running for office for another eight years, a period that adds to the ineligibilities previously determined by the Superior Electoral Court, which initially would have allowed his candidacy in 2030.

Application of the Clean Record Law

In the decision that enforced the sentence of the defendants considered to be part of the central core of the alleged conspiracy, Moraes applied the Clean Record Law to make all those convicted ineligible for a period of eight years, counted from the publication of the collective judgment. The measure directly affects the political plans of the former president, who was already barred from participating in the 2026 election.

Despite being unable to run for office himself, Bolsonaro has tried to maintain his relevance in the electoral landscape as a political strategist.

The defense, caught off guard, prepares appeals

The execution of the sentence surprised Bolsonaro’s defense, although his lawyers had already feared this outcome. The legal team expected Moraes to wait for the presentation of the appeals before determining the execution of the sentence. Despite the setback, the defenders did not give up on the appropriate appeals and, according to the report, they should file them by next Friday (28).
